OF THE COLLEGIUM OF THE PEOPLE'S COMMISSARIAT OF JUSTICE

To the Council of People's Commissars
Regarding the question of whether private associations and enterprises are subject to the control of the People's Commissariat
of the Workers' and Peasants' Inspection, I consider it necessary to give
the following information:
1. Regarding cooperative
associations:
According to the Regulations on the Workers' and Peasants' Inspection and the rules on
preliminary and actual control, now repealed, the Workers' and Peasants' Inspection had the right to audit both
governmental and public organizations, and under public organizations
must be understood cooperative organizations...
The decree of June 10, 1921, on the abolition of preliminary
control in relation to cooperation abolished preliminary
audit of cooperative organizations, however, "the audit
of cooperative organizations is entrusted to the Workers' and Peasants' Inspection in
the order of actual and subsequent audit within the limits of the rights granted to the Workers' and Peasants' Inspection and
established rules of audit."
...But since the decree of June 10, cited above, has not been repealed,
the special decree on industrial cooperation should, obviously, be understood in
the sense of abolishing preliminary audit, but not the right of subsequent control. Recognizing the right
of the Workers' and Peasants' Inspection to subsequently control cooperative
organizations, it is necessary, however, to stipulate that
this right under the new economic policy must be recognized with certain limitations.

Regarding the activities of private enterprises, the Regulations on the Workers' and Peasants' Inspection do not establish
any rights with respect to audit and control..
However, it would be a mistake to conclude that the bodies of the Workers' and Peasants' Inspection have no rights to control with respect to private industry.
First of all, since the Workers' and Peasants' Inspection is entrusted with
overseeing the implementation of the decrees of the Soviet
government, it is quite obvious that violation of these decrees by private industrialists
gives the Workers' and Peasants' Inspection the right to bring violators
to judicial responsibility. On the other hand, since private industry
is now spreading through the lease of state enterprises, it is quite obvious that
in this respect, too, the Workers' and Peasants' Inspection
must have

the Workers' and Peasants' Inspection has the right to control
not only as a body of state power, which is obliged to monitor the proper fulfillment
of contracts by the tenant, but also has the right to control the proper storage of state
property and its use not to the detriment of the state...
In conclusion, I consider it necessary to indicate that in view of the contradictory and inconsistent
nature of the legislation regarding the rights of the Workers' and Peasants' Inspection,
it is necessary to supplement the new Regulations on the Workers' and Peasants' Inspection
with relevant articles that would clearly define the rights of the Workers' and Peasants' Inspection
in relation to both cooperative enterprises and private industry enterprises.

I think you are right.
It is necessary to obtain the consent of the Politburo and start «reducing»*:
1) composition: five people indicated by you, plus 2 departmental ones
(Belov+?) = 7; approximately,
2) appropriations provided for by the state budget, first in
the NCF and the Workers' and Peasants' Inspection; in the Small SNK only in the order of appeal;
the rest as you have it.
To state, after considering again, in writing these foundations of reduction
of the Small SNK, to take the opinion of the chairman of the Small SNK,
to pass these foundations through the Politburo and then quickly to develo
them into a new regulation.
Maybe, further limit commissions? strengthen the role of
actual verification? subordinate all work more directly
to the deputy chairmen of the STO?
