NOTES ON A LETTER FROM P. A. KRASIKOV

Vladimir Ilyich, Regarding the Litkens matter . . . for now one can say firmly only the following:

1) The matter concerning the unlawful dismissal of workers and employees is not subject to disciplinary comradely court under article 8 of the regulations.

2) Two . . . of those brought in belong to persons appointed by the SNK, and therefore cannot be tried in an official matter by a disciplinary court.

3) In essence, the matter concerning them must be examined in the general procedure, or in the procedure of the decree of 27 January 1921.

4) Our investigative department has already received the matter, but on the merits of the charges presented it is necessary to gather materials, since the matter was conducted chaotically, with violations of the procedure for directing the matter, and besides that new documents are arriving . . . which had not appeared before. For this reason, a conclusion on the merits will be given within 2–3 days.

5) In view of the lack of clarity and insufficient coordination of individual articles in the regulations on disciplinary courts and the inconsistency of the entire regulations as a whole with general legislation, it is necessary that the SNK adopt a general resolution on the revision of the regulations on disciplinary courts (the Commission of the Org. Bureau reached the same conclusion).

That means one must immediately submit to the MSNK a draft resolution: "Recognize revision as necessary, instruct the NKYu (in agreement with the VTSPS?) within a 3-day period."

6) Regarding publication, an article will be written by Krylenko or Goikhbarg. Please inform when and where it will appear.

7) With the VTSPS we will try to come to agreement on theses, conceding the sphere of comradely ethics and discipline, but excluding official and service crimes and violations.
