On the path to communism through the dictatorship of the proletariat, the communist party, discarding democratic slogans, abolishes without remainder also such organs of bourgeois rule as courts of the former structure, replacing them with class worker-peasant courts. Having taken all power into its own hands, the proletariat, instead of the former vague formula: "Election of judges by the people," puts forward the class slogan: "Election of judges from the toilers only by the toilers" and implements it in the entire organisation of the court. Electing to the composition of the court only representatives of workers and peasants who do not use hired labour for the purpose of extracting profit, the communist party makes no distinction for women, equalising both sexes in all rights both in the election of judges and in the discharge of judges' duties. Having annulled the laws of the overthrown governments, the party gives the judges elected by the Soviet electors the slogan – to carry out the will of the proletariat, applying its decrees, and in the event of the absence of a corresponding decree or its incompleteness, to be guided by socialist legal consciousness, casting aside the laws of the overthrown governments.
