III.
In all conflicts or friction or misunderstandings or disputes concerning the limits of jurisdiction and the like between officials or institutions of Soviet power—all such persons and institutions are obliged immediately to draw up the briefest protocol with mandatory indication of the date, place, names of officials or name of the institution and the briefest indication (not exposition) of the essence of the matter. A copy of the protocol must be transmitted to the other party.

IV. Such same brief protocols are obliged to be drawn up by each official or institution of Soviet power, if any citizen of the Republic lodges a complaint against any measure whatsoever (or red tape, etc.) of this official or institution. A copy must be communicated to the complaining citizen, and another to the superior institution.

V. For a patently groundless demand for a protocol, constituting gross abuse, prosecution in court is threatened.

VI. Refusal to issue a protocol with a clearly written name of the official is a grave crime in office.

I propose: The Central Committee approves in principle and charges the People's Commissariat of Justice with drafting this as a decree*.

DECREE OF THE COUNCIL OF PEOPLE'S COMMISSARS
NOVEMBER 12, 1918

The Council of People's Commissars decrees: to issue to workers and employees of private nationalized and state factories and enterprises, which temporarily were under the power of the White Guard or Czechoslovak government, the maintenance and wages owed to them for the time of occupation of the factories according to the rates established by the People's Commissariat of Labor.

* On November 8, 1918 the VI All-Russian Extraordinary Congress of Soviets adopted a resolution "On Strict Observance of Laws," composed on the basis of Lenin's theses approved by the Central Committee of the party. The resolution was published in *Izvestia* No. 267, December 6, 1918.

1917—1918 YEARS

Wages and maintenance are not subject to payment to workers and employees in full or in part in those cases when it is proven that the given factory or enterprise or individual parts thereof rendered active voluntary support to the enemy or assisted it in its struggle against Soviet power.

The payment of wages and maintenance must be made at the expense of those persons, institutions and departments in whose jurisdiction the occupied factory was at the moment of its capture by the enemy, or their successors.

The question of whether the aforesaid voluntary active assistance to the enemy took place is resolved in each individual case by a special commission composed of: 1 representative from the Supreme Council of the National Economy, 1 representative from the Commissariat of Military Affairs, 1 representative from the All-Russian Council of Trade Unions, 1 representative from the People's Commissariat of State Control and 1 representative from the People's Commissariat of Labor.

The present decree is not subject to publication.
