A new attempt at mediation compels me, for the time being, to employ
all available “methods of struggle” against the adversary. Therefore, I request that, until further notice, you refrain from taking any official steps.
I hope to receive important documents in the near future, which I will deliver to you. In my view, these documents may well alter your assessment of the “somewhat uncertain legal status.”

1 This letter is a response to a letter from Stuttgart lawyer A. Kan, dated April 1 (N.S.), 1913. In his letter, Kan had requested that V. I. Lenin sign and forward to him a power of attorney that would strengthen his position as the owner of funds held by the “custodians,” granting him the right to recover 35,000 francs improperly withheld from the Bolsheviks.

I am sending you the draft of Duke’s letter to the “custodians.” Please translate it as soon as possible—and perhaps it will be less difficult for you if, where feasible, you can negotiate with Duke in writing, that is, by sending him the draft and requesting that he return it promptly, incorporating his own revisions. It is of utmost importance to bring this matter to a close before the vacat.
Dear Comrades!
I am enclosing for your consideration the opinion rendered jointly by myself and Comrade Willem¹ regarding the case that has given rise to your dispute with Comrade Lenin (Ulyanov). The opinion is based primarily on your own letters and addresses the issue first and foremost from the standpoint of justice (avis’a) and politics, only then from the perspective of law.
Allow me to express my hope that you will not refuse to accept my mediation and take the necessary steps so that this conflict may be resolved peacefully—and that, should there be any points that remain unclear in fact (if such points exist), you will agree to work together with us to clarify and settle them.
